Event RSVP TERMS & CONDITIONS


PLEASE READ CAREFULLY. By RSVP’ing to, registering for, checking in at, or attending any Event, you agree to these Terms. They include an assumption of risk, a release of liability, a grant of rights to your name and likeness, and a binding arbitration provision with a class-action waiver. You are giving up legal rights, including the right to sue in court and to a jury trial. If you do not agree, do not attend.


1. Released Parties. “Released Parties” means FOL Management LLC and all of its past, present, and future parents, subsidiaries, affiliates, and related or commonly-controlled entities, together with each of their owners, members, managers, officers, directors, employees, contractors, agents, vendors, insurers, successors, and assigns, and any venues or property owners used for an Event. Each is an intended third-party beneficiary entitled to enforce these Terms.


2. Events. These Terms apply to any and all events, activities, classes, performances, and experiences hosted, produced, promoted, or facilitated by FOL, including DJ and music events, parties, fitness and wellness activities, workshops, and food and beverage events, whether on FOL or third-party premises, outdoors, or virtual, plus any related use of facilities, equipment, and transportation. This scope is intended to be read as broadly as the law allows.


3. Assumption of Risk. You understand that participation is voluntary and involves inherent risks of injury, illness, property damage, and death — including from physical exertion, slips and falls, crowds, loud sound and lights, food and alcohol, weather, equipment, the acts of others, and exposure to communicable disease. You knowingly assume all such risks, whether known or unknown, and confirm you are physically able to participate.


4. Waiver & Release of Liability. To the fullest extent permitted by law, you release, waive, and covenant not to sue the Released Parties from any and all claims, damages, losses, and costs (including attorneys’ fees), known or unknown, arising out of or relating to your (or any accompanying minor’s) attendance or participation, including claims based on the Released Parties’ ordinary negligence. This does not waive liability for gross negligence, recklessness, or willful misconduct, or any liability that cannot be waived by law. If California law applies, you waive California Civil Code § 1542 and similar laws regarding unknown claims.


5. Indemnification. To the fullest extent permitted by law, you agree to indemnify and hold the Released Parties harmless from any claims, damages, and costs (including reasonable attorneys’ fees) arising from your attendance or participation, your breach of these Terms, or the participation of any minor for whom you are responsible.


6. Media & Likeness Release. Events may be photographed, filmed, live-streamed, and recorded. You grant the Released Parties an irrevocable, perpetual, worldwide, royalty-free, transferable, and sublicensable right to use your name, image, likeness, voice, and appearance, in any media now known or later developed, for any lawful purpose including advertising and promotion, without further approval or compensation. You release the Released Parties from claims relating to such use (including privacy, publicity, and defamation). Incidental capture in crowd or venue footage may occur.


7. Minors. You must be 18+ to agree on your own behalf. A parent or guardian who registers or permits a minor to attend agrees to these Terms (including the release and media release) on the minor’s behalf and their own.


8. Arbitration & Class-Action Waiver. Any dispute relating to these Terms or any Event will be resolved by final, binding, individual arbitration under the Federal Arbitration Act (small-claims court excepted). YOU AND FOL WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS OR REPRESENTATIVE ACTION. Arbitration will be administered by JAMS or the AAA under its consumer rules, in the county and state where the Event was held. You may opt out of this Section by written notice to [OPT-OUT EMAIL] within 30 days of your first RSVP.


9. Governing Law; Misc.. These Terms are governed by the laws of the state where the applicable Event is held, without regard to conflict-of-laws rules. Events are provided “as is,” and FOL may modify, reschedule, or cancel any Event. FOL’s total liability will not exceed the greater of the amount you paid to attend or $100, and the Released Parties are not liable for indirect or consequential damages, to the fullest extent permitted by law. If any provision is unenforceable, it will be limited or severed and the rest remains in effect. These Terms may be updated; the version in effect when you RSVP or attend governs.
